Commercial disputes involved things that are owned or owed. The disputes could be about; money, property, goods, services, intellectual property or boundaries – these are all causes of commercial disputes. Any type of civil dispute can be mediated. There is no limit to the type of dispute that can be mediated at FMC, nor any upper limit on the quantum in dispute. We have facilitated the mediation of disputes in a range of commercial areas – including banking, construction, healthcare, employment, information technology, insurance, partnership, shipping and tenancy disputes. With an efficient Secretariat and an effective and skilled Panel of Mediators, we can convene a mediation session within days. Our fees are pegged to the sum of dispute. FMC’s mediation fees start from F$800 (inclusive of VAT) per party per day.

Expensive and prolonged litigation can exhaust time and resources, particularly in instances of small claims; mediation provides a time and cost-effective solution that puts you in control of the outcomes. The Small Case Mediation Scheme provides mediation services to help parties settle disputes where the sum of claim is F$50,000 or less. Typically, cases include those involving tenancy, car repairs, unpaid salaries and renovation matters etc. The mediation fee is designed to be affordable and the fee starts from $80.25 (inclusive of VAT) depending on your size of claim.
